How come? How was the contract for the CD constructed? As I understand those are not new pressings, just the old ones stacked in someone's cellar. You wasn't paid for all the CDs that were printed? Or you just agreed on a fixed fee and didn't had % of sales? Give us some more detail on this :)

p.s. instead of questioning, maybe you should do some research on the oldskool not-labels, but distribution companies who not only fucked the labels but fucked the artists in the process of fucking the labels mr. always know it all artur. this was repeated behavior with psy labels [and many other non psy labels] and still carries the tradition onward even today.

The album was distributed through Flying, which went bankrupt shortly after the release. It was a regular deal with %royalties, but the label never paid properly and after Flying went down, they were unable to even if they'd wanted. Flying's stock was sold off to recoup the company's losses, however the liability to pay artist royalties was not sold with it (ie. the sale was 'unencumbered' <_< - like us artists are such a burden to the CD-selling industry). I can only presume this was the route by which Kagdila came by stock of the album. The rights to the album have reverted to us and as far as I know, Kagdila strictly speaking no longer has the right to sell aLIVE; whilst it's a bit of a wierd situation we don't mind much - good luck to them, glad the music's still getting out there somehow :)

 

EDIT: To clarify, Kagdila is under no obligation to pay us anything for the copies of aLIVE they sell, as they bought the stock when the original distributors went bankrupt.

What's your problem? I'm not investigating MY shit, just want to know more about old-school scene, because I'm interested in the music and everything surrounding it. And asking publicly might benefit other people, who are curious about how the scene worked back then. I know there were a lot of scams then and people weren't paid etc. but I do not have knowledge of every single instance of such case. Not everyone has been in the scene for ages, not everyone know the artists, not everyone has kick-ass big collection of rare stuff etc. If Colin would feel offended or thought it is too personal he'd have not replied or replied by PM. So, maybe it is you who should shut up?

What you mean? How can one disagree with questions?! Normally, when there is a contract between artists and label he gets pay for each copy of CD sold, so if someone finds in his cellar a crate with D5 albums it means they must have been sold back then and the artist got his cut. It is irrelevant that they were only costing 10E back then, and now they can fetch up to 500E (or whatever). It is probably ethically wrong, but that is how free market works.

 

Now it is completely another story if label went down and never paid. But even then, when Colin wrote "we don't make any money from these sales at all" he, maybe unintentionally, implied that he SHOULD be getting his cut from those sales. Which he clearly isn't entitled to, like he explained in another mail.

 

So, don't jump at me guys trying to crucify me for wanting to know the details.

The way it feels to me is that morally, we should be getting paid from the sales of unopened CDs of our music. Legally, we aren't entitled. Sorry if my first post confused things.

Not sure though, but I thought it'd be worthwhile to point that out.

 

Back on this topic, there is a super rare version of "A Live" with a different, alterantive cover I bought straight from the source back in the day :)

 

Not sure if Colin has any more of those left but this might be your chance to score that edition.

No, it wasn't confusing. It just triggered my curiosity as to why you're asking for your cut on those CDs and now I understand it.

Oh, didn't noticed it. I'm not a native English speaker (obviously :)), so I've matched the word I saw with closest similar word I knew ;):D Anyway, after checking it in the dictionary it doesn't change the meaning that much :)
